1. Información general y partes

Las presentes Condiciones Generales de Venta (en adelante, las "Condiciones") regulan la compra de productos a través del sitio web gripfilm.com (el "Sitio Web"), titularidad de:

2. Objeto y aceptación

Estas Condiciones regulan la venta de los productos ofrecidos por GripFilm (equipamiento profesional de grip y rodaje). Al realizar un pedido, el cliente declara haber leído y aceptado estas Condiciones. GripFilm puede modificarlas; se aplicará la versión vigente en el momento de cada pedido.

3. Tipos de cliente

• Consumidor: persona física que compra para un uso ajeno a su actividad profesional. Goza de los derechos imperativos de la normativa de consumo (desistimiento, garantía, etc.).
• Cliente profesional (B2B): empresa, autónomo o profesional que compra en el marco de su actividad. No le aplican los derechos de consumidor; su relación se rige por estas Condiciones y la normativa mercantil.

4. Proceso de compra y formalización del contrato

Antes de finalizar la compra se muestra un resumen del pedido. El contrato se entiende perfeccionado cuando GripFilm confirma el pedido mediante correo electrónico. Conforme al art. 27 de la LSSICE, se informa de que: los trámites para contratar son la selección de productos, la introducción de datos de envío/facturación y pago, y la confirmación; el documento de compra se archiva electrónicamente y es accesible a petición; el cliente puede corregir errores de introducción de datos antes de confirmar; y el contrato puede formalizarse en español o inglés.

5. Productos y disponibilidad

Las características de cada producto figuran en su ficha. GripFilm fabrica en España y procura mantener la información actualizada; si un producto no estuviera disponible tras el pedido, se informará al cliente y se reembolsará cualquier importe abonado por ese producto.

6. Precios e impuestos

Los precios figuran en la moneda indicada en el Sitio Web e incluyen o excluyen impuestos según el tipo de cliente:

• Consumidores: el precio mostrado al consumidor incluye el IVA aplicable.
• Clientes profesionales: los precios pueden mostrarse sin IVA; el IVA aplicable, o la exención por VAT intracomunitario válido, se reflejará en el checkout y la factura.

Los precios no incluyen los gastos de envío ni, en su caso, los aranceles e impuestos de importación en destino (ver Sección 7), que se indican por separado.

7. Envíos, plazos y modelo DAP (aranceles e impuestos de importación)

GripFilm envía desde España a todo el mundo. Los plazos de entrega dependen del destino y del transportista seleccionado, y se indican de forma orientativa durante el proceso de compra. Son estimaciones y pueden verse afectados por trámites aduaneros u otras circunstancias ajenas a GripFilm.

Importante (envíos fuera de la UE — modelo DAP): los pedidos se entregan bajo el incoterm DAP (Delivered At Place). Esto significa que el precio y los gastos de envío no incluyen los aranceles, el IVA de importación ni las tasas de despacho que el país de destino aplique a la entrada de la mercancía. Dichos importes los abona el cliente (o el destinatario) al transportista o a la aduana en destino como condición para recibir el pedido. GripFilm recomienda al cliente informarse de los costes de importación de su país antes de comprar.

8. Formas de pago

GripFilm acepta los siguientes medios de pago: [FORMAS DE PAGO — confirmar lista de IM Beauty]. Los medios de pago disponibles pueden variar, y prevalecerán los efectivamente ofrecidos en el momento del checkout. El pedido no se tramita hasta confirmarse el pago.

9. Derecho de desistimiento, devoluciones y reembolsos

Los consumidores disponen del derecho de desistimiento de 14 días naturales y del resto de condiciones de devolución y reembolso recogidas en la Política de Devoluciones, Reembolsos y Desistimiento, que forma parte de estas Condiciones. Los clientes profesionales se rigen por la política de devoluciones comerciales allí descrita.

10. Garantía

Los consumidores disponen de la garantía legal de conformidad prevista en la normativa de consumo (con carácter general, 3 años para bienes adquiridos desde 2022). Para clientes profesionales, la garantía se rige por lo pactado y, en su defecto, por la normativa mercantil. El detalle figura en la Política de Devoluciones.

11. Responsabilidad

GripFilm responde del uso conforme a derecho del Sitio Web y de la correcta ejecución del contrato. No responde de incidencias derivadas de información falsa o inexacta facilitada por el cliente, ni de retrasos o costes en aduana ajenos a su control en el marco del modelo DAP.

12. Propiedad intelectual

Los contenidos del Sitio Web (textos, imágenes, marcas, logotipos) son titularidad de GripFilm o de terceros con licencia, y no pueden reproducirse sin autorización.

13. Protección de datos

El tratamiento de datos personales se rige por la Política de Privacidad del Sitio Web.

14. Atención al cliente y reclamaciones

15. Resolución alternativa de litigios

Si eres consumidor y no estás conforme con la respuesta a tu reclamación, puedes acudir a una entidad de resolución alternativa de litigios (RAL/ADR) acreditada competente. En litigios transfronterizos dentro de la UE, puedes contactar con la Red de Centros Europeos del Consumidor (ECC-Net).

GripFilm no está adherido a ningún sistema arbitral de consumo.

16. Ley aplicable y jurisdicción

Estas Condiciones se rigen por la ley española. Para los consumidores se respetan las normas imperativas de su país de residencia en la UE y la competencia de los tribunales de su domicilio. Para clientes profesionales, las partes se someten a los Juzgados y Tribunales de Zaragoza, con renuncia a cualquier otro fuero.

17. Idioma del contrato

El contrato puede formalizarse en español o en inglés, según la versión del Sitio Web utilizada por el cliente.

2. Purpose and acceptance

These Terms govern the sale of the products offered by GripFilm (professional grip and film equipment). By placing an order, the customer confirms they have read and accepted these Terms. GripFilm may amend them; the version in force at the time of each order applies.

3. Types of customer

• Consumer: a natural person buying for purposes outside their trade or profession. Enjoys the mandatory rights under consumer law (withdrawal, guarantee, etc.).
• Business customer (B2B): a company, self-employed person or professional buying in the course of their business. Consumer rights do not apply; the relationship is governed by these Terms and commercial law.

4. Purchase process and conclusion of the contract

A summary of the order is shown before checkout is completed. The contract is concluded when GripFilm confirms the order by email. In accordance with Art. 27 of the Spanish E-Commerce Act (LSSICE): the steps to contract are selecting products, entering shipping/billing and payment details, and confirming; the purchase document is stored electronically and accessible on request; the customer may correct input errors before confirming; and the contract may be concluded in Spanish or English.

5. Products and availability

The characteristics of each product appear on its product page. GripFilm manufactures in Spain and strives to keep information up to date; if a product becomes unavailable after the order, the customer will be informed and any amount paid for that product refunded.

6. Prices and taxes

Prices are shown in the currency indicated on the Website and include or exclude taxes depending on the type of customer:

• Consumers: the price shown to the consumer includes the applicable VAT.
• Business customers: prices may be shown excluding VAT; the applicable VAT, or the exemption for a valid intra-EU VAT number, will be reflected at checkout and on the invoice.

Prices do not include shipping costs or, where applicable, import duties and taxes at destination (see Section 7), which are stated separately.

7. Shipping, delivery times and DAP model (import duties and taxes)

GripFilm ships from Spain worldwide. Delivery times depend on the destination and the carrier selected, and are shown on an indicative basis during checkout. They are estimates and may be affected by customs procedures or other circumstances beyond GripFilm's control.

Important (shipments outside the EU — DAP model): orders are delivered under the DAP (Delivered At Place) incoterm. This means the price and shipping costs do not include the import duties, import VAT or customs clearance fees that the destination country applies to incoming goods. Those amounts are paid by the customer (or recipient) to the carrier or customs at destination as a condition for receiving the order. GripFilm recommends that customers check their country's import costs before purchasing.

8. Payment methods

GripFilm accepts the following payment methods: [PAYMENT METHODS — confirm list from IM Beauty]. The available payment methods may vary, and those actually offered at checkout shall prevail. The order is not processed until payment is confirmed.

9. Right of withdrawal, returns and refunds

Consumers have the 14-calendar-day right of withdrawal and the other return and refund conditions set out in the Returns, Refunds and Withdrawal Policy, which forms part of these Terms. Business customers are governed by the commercial return policy described there.

10. Guarantee

Consumers benefit from the legal guarantee of conformity under consumer law (generally 3 years for goods purchased from 2022). For business customers, the guarantee is governed by the terms agreed and, failing that, by commercial law. Details are in the Returns Policy.

11. Liability

GripFilm is responsible for the lawful use of the Website and the correct performance of the contract. It is not liable for incidents arising from false or inaccurate information provided by the customer, nor for customs delays or costs beyond its control under the DAP model.

12. Intellectual property

The Website's content (text, images, trademarks, logos) belongs to GripFilm or to licensed third parties and may not be reproduced without authorisation.

13. Data protection

The processing of personal data is governed by the Website's Privacy Policy.

14. Customer service and complaints

15. Alternative dispute resolution

If you are a consumer and are not satisfied with the response to your complaint, you may turn to a competent accredited alternative dispute resolution (ADR) body. For cross-border disputes within the EU, you may contact the European Consumer Centres Network (ECC-Net).

GripFilm is not adhered to any consumer arbitration scheme.

16. Governing law and jurisdiction

These Terms are governed by Spanish law. For consumers, the mandatory rules of their EU country of residence and the jurisdiction of the courts of their domicile are respected. For business customers, the parties submit to the Courts of Zaragoza, waiving any other jurisdiction.

17. Language of the contract

The contract may be concluded in Spanish or English, depending on the version of the Website used by the customer.
